Mr. Kulkarni, the learned advocate for the petitioner submits that, the advertisement dated 13.10.2018 published in Daily Lokmat and Daily Punyanagari thereby calling sealed proposals for handing over/transfer of primary Ashram Shala Waghela Tanda, Tq. Chalisgaon is under challenge. The petitioner had filed an appeal before the Hon'ble Chief Minister against the order dated 31st July, 2017 of the Hon'ble Minister and appeal is pending.

The learned A. G. P. submits that, against the order dated 31.07.2017, the President of the institute of which the petitioner

2 wp 13902.18 claims to be Secretary had filed Writ Petition No. 12515 of 2017 in this Court and said writ petition is dismissed. 3.

In the light of that, the appeal filed by the petitioner also would not survive. This Court under its order dated 07.08.2018 in Writ Petition No. 12515 of 2017 had dismissed the petition filed by the President of Gautam Magasvargiya Shaikshanik Sanstha Chalisgaon challenging the order passed by the respondent No. 1 thereby cancelling recognition granted in favour of the petitioner institute to run the Ashram School. 4.

In view of that, now the petitioner would not have locus to assail the impugned advertisement. The writ petition as such is dismissed. No costs.
