Heard the learned counsel for the applicant.

This is a successive bail application after dismissing his earlier bail application before filing the chargesheet. 3.

The applicant seeks bail in C.R.No.87 of 2023 registered with Police Station Talwada, District Beed, for the offences punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code.

The first information report did not disclose the name of the applicant. However, his name has been transpired from the statement of the co-accused. A perusal of the chargesheet reveals that few persons assaulted the deceased with belt and wire. He

6-BA-1990-23.odt suffered multiple injuries and died. The similarly situated coaccused have been granted bail. Nothing is to be recovered from the applicant. Considering the role attributed to the applicant, the Court is of the view that the applicant deserves bail. Hence, the order:- i) The application is allowed.

ii) Applicant Ganesh Santosh Jadhav be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses.
