Heard learned counsel for the respective parties for some time.

This writ petition is preferred against the order passed by the Divisional Commissioner allowing the revision application of the Respondent, thereby confirming the order passed by the Tahesildar and SDO dated 31st December 1997 and setting aside the order passed by the Divisional Commissioner dated 27th May 1998. The said order was passed subject to the orders passed by this Court. It is submitted that at the relevant time, Second Appeal No.443 of 2004 was pending before this Court. It is further pointed out that the said second appeal came to be withdrawn in view of compromise between the parties. The order passed by the Appellate Court is confirmed.

In view of the same, now it is submitted that the present writ petition deserves to be allowed.

The learned counsel mainly observed that she has no objection in view of the subsequent events to allow the writ petition. The writ petition, therefore, stands allowed in terms of prayer clause (b). The order passed by the Collector stands confirmed. 5.

Writ Petition stands disposed of.
