After this matter was heard for sometime, learned counsel for the petitioner submits on instructions from the petitioner, who is present in the court that he desires to withdraw the petition. He prays for an observation that the interlocutory order under challenge, should not influence the trial Court while deciding RCS No.1089 of 2014. 2.

Learned counsel for the respondent submits that such observations are always prima facie in nature.

In the light of the above, this petition is disposed off as withdrawn, on instructions, Needless to state, the interlocutory order dated 30.1.2015 is in reference to application Exhibit 5 and the judgment dated 14.10.2015 in MCA No.44 of 2015, would not influence the trial Court while deciding RCS No.1089 of 2014, on its own merits.
