On 25 October 2018 following order was passed indicating that the suit itself has been dismissed in default and the writ petition may have become infructuous:

" This petition was listed on 3rd September 2018 when the following order was passed :

"The learned counsel for the petitioner submits that, the suit from which this writ petition arises itself has been dismissed in default and that the application for restoration of the same is pending before the trial Court. In that view of the matter, list this petition after three weeks." 2.

When the petitioner called out today none appeared on behalf of the petitioner. Hence, list the petition after two weeks as last chance."

None had appeared on behalf of the petitioner on last two occasions and the petition was adjourned by way of last chance. 3.

It appears that the petition has become infructuous and the petitioner has lost interest in prosecuting this petition. The petition is disposed of as infructuous.
