By filing this civil application, the applicants have prayed for permission to bring on record L.Rs. of deceased respondent no.2-A Appa Trimbak Gilbile. It has been mainly contended by the applicant that respondent no.2-A has expired on 29/09/2016 at village Umri (Bk) and he is survived by his L.Rs. A to E as contended in para no.2 of the application. The present civil application is filed on 08/12/2016. A copy of death certificate on record clearly indicates that Appa Gilbile expired on 29/09/2016. The heirship certificate is also filed on record. The application is filed in time and there is no contest to the civil application. Hence, following order.

ORDER

The C.A. No. 3576/2017 is hereby allowed.

The applicants are permitted to bring on record L.Rs. of deceased respondent no.2-A Appa Trimbak Gilbile. Necessary amendment to be carried out in the memo of appeal within a period of limitation.
