The contention of the petitioner is that his case is clearly covered by the judgment dated 4th November, 2009 delivered by this Court in Writ Petition No.1491 of 2001 (Sahebrao Karbhari Gunjal and others Vs. The State of Maharashtra and others). A representation dated 29th October, 2013, in view of the said law, is pending before respondent No.1.

The learned AGP submits that as the said representation is almost 10 years old Let the petitioner file a fresh representation and the same would be considered expeditiously.

In view of the above, this petition is disposed off.

If the petitioner tenders a representation to respondent No.1, within 30 days, we expect respondent No.1 to look into the said representation and take a decision thereon, by considering the Policies / Government Resolutions applicable and the judgment of this Court dated 4th November, 2009, on it's own merits.
