IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL WRIT PETITION NO.1587 OF 2015 The State of Maharashtra ..Petitioner

Versus

Sanjay @ Bhaurao Chaudhari and ors.

..Respondents -- Mr.N.T.Bhagat, APP for petitioner - State Mr.Bhushan Kulkarni, advocate for respondent nos.1 to 3 Mr.Joshi, advocate i/b. M/s. J.P.Legal Associates for respondent no.4 -- CORAM : M.T. JOSHI, J.

DATE : JANUARY 28, 2016 PER COURT :

Heard both sides.

2] Mr.Joshi, learned counsel, tenders Vakilpatra on behalf of respondent no.4. The same is accepted on record and marked as "X" for the purpose of identification. He also files on record certified

2 26-crwp1587-15.odt copies of the orders passed by learned Addl. Sessions Judge. The same are accepted on record and collectively marked as "X-1" for the purpose of identification.

3] Certified of Roznama filed by learned A.P.P.

is accepted on record and marked as "X-1" for the purpose of identification.

4] Perused the material on record. While it should be the anxiety of the State to have speedy trial, it appears that the State is prolonging the matter. It would not be an outlook of the court that as a Special Public Prosecutor from Nashik, is appointed, the Court should adjourn the Sessions Case, even on the date, six witnesses were present in the Court.

5] In view of the above, I do not find it unjustified, if the learned Addl. Sessions Judge

3 26-crwp1587-15.odt has imposed costs on the prosecution/State vide the impugned order.

6] Present Criminal Writ Petition is, therefore, dismissed.
