At the outset, Mr. V. B. Anjanwatikar, learned counsel informs that his client has taken no objection from him and Mr. Sunil S. Thite, learned counsel is appearing on behalf of the applicant / claimant. In view of the same, the appearance of Mr. V. B. Anjanwatikar, learned counsel stands discharged.

Heard the learned counsel for the parties.

Application for withdrawal of amount:

This application is for withdrawal of the amount of compensation

22 ca.13016.24.odt deposited by the appellant / MSRTC in the office of this Court. Since the amount is towards injury claim and the applicant himself has received the injury, this Court is inclined to allow the application. Hence, the following order is passed:-

O R D E R

I.

The applicant is permitted to withdraw 50% of the amount alongwith accrued interest deposited in this Court on furnishing usual undertaking. Further 25% of the amount with accrued interest is allowed to be withdrawn on furnishing solvent surety/security to the satisfaction of the learned Registrar (Judicial) of this Court. The remaining amount be kept in fixed deposit in any nationalized bank till disposal of the appeal. II.

With this, the civil application for withdrawal of amount stands disposed of.
