The applicant - original plaintiff who suffered a decree for eviction and possession in counter claim as questioned, concurrent findings against him recorded by both the Courts below in the present application. 2.

This Court has heard the matter for sometime and expressed that the Court is not inclined to show any indulgence at the behest of applicant/tenant at which point of time the applicant who is personally present in the Court through his advocate has tendered an undertaking in the form of affidavit.

The applicant through his Advocate made an oral submission that he shall leave the suit premises by 31st October, 2017 by handing over vacant possession of the same to the non-applicant/owner. 4.
