The applicants seek to condone the delay of 94 days caused in filing the appeal against the award passed by the Tribunal under the provisions of the Motor Vehicles Act. 2.

Heard Mr. Dhongade, learned counsel appearing for the applicant and Mr. Dhongade, learned counsel appearing for respondent no.1. Inspite of service of notice, none appears for respondent no.2.

Having considered the submissions advanced by the learned advocates appearing for the parties and on perusal of the reasons as stated in paragraph nos.3 to 5 of the application, the case is made out to condone the delay. Hence, civil application is allowed. Delay of 94 days caused in filing the appeal is condoned. Civil application stands disposed off. 4.

First Appeal be registered. On registration of the appeal, issue notice to the Respondents, returnable on 25.6.2024. Mr. Bourlkar, learned advocate waives notice for respondent no.1.
