CORAM : MANGESH S. PATIL, J.

DATE : 10.12.2019 P.C. :- Heard the learned advocate for the original claimant and the learned advocate Mr.S.S.Dande for the acquiring body. 2] The original claimant is seeking withdrawal of the amount of compensation deposited in this Court.

3] The learned advocate Mr.Dande submits that the Land Acquisition Officer had awarded compensation at the rate of Rs.600/- per Are which has been exorbitantly enhanced to Rs.14,000/- per Are (Rs.14/- per Sq.ft.). Therefore, the claimant may not be allowed to withdraw the entire amount. 4] Having considered the reasoning given by the Reference Court, it would be appropriate to allow the claimant to withdraw 75% of the amount with interest.

5] The application is allowed. The applicant is allowed to withdraw 75% of the amount deposited in this Court with interest, 50% by furnishing usual

( 2 ) ca14254-19 undertaking and 25% by furnishing solvent security. 6] The application is disposed of.
