It is beyond debate, in the light of the Government Resolution dated 20.03.2019, that the order passed by the Education Officer (Primary), impugned in both these petitions,

*2* 965a966wp14158a14159o23 pertaining to the decision as to whether, the names of the Petitioners should be entered in the Shalarth Pranali/ ID, is without jurisdiction.

The learned Advocate for the Respondent/ Zilla Parishad submits, on instructions, that the said order would be withdrawn and the proposal of these Petitioners would be forwarded to the competent Authority along with the file so as to be dealt with by the said Authority in accordance with law and policies applicable.

In view of the above, both these Writ Petitions are disposed off.

Let the competent Authority deal with the proposals as regards these Petitioners, on or before 31.12.2023. 5.

We permit the Petitioners to tender a copy of the order passed by this Court, before the Deputy Director of Education to enlighten him.
