The petitioner/plaintiff has challenged the impugned order dated 10/10/2018 by which his application Exh.119 seeking an amendment in RCS No.96/2011, has been rejected.

Learned Advocate submits on instructions from the petitioner that his suit has been dismissed by the Trial Court and this petition is rendered infructuous.

In view of the above, this petition is disposed of as being infructuous. Needless to state, in the event the petitioner prefers a remedy against the dismissal of his suit, all contentions are kept open, including that he had desired to amend the plaint.
