After hearing the learned Senior Counsel for the applicant for a while, the Court expressed its dis inclination to grant relief to the applicants Sudhir, Ganesh and Amol, on instructions, he came around to withdraw the application to their extent. The application to the extent of Sudihr, Ganesh and Amol stands disposed of as withdrawn.

Applicant No. 1 is a woman. She had emotional relationship with the deceased. Applicant No. 3 is the father of applicant No. 1, who is 58 years of age. The deceased has left behind suicide note attributing the other applicants, somewhat severe role than the role attributed to applicant Vijaya and her father Nandu. The suicide note indicate that the applicants, who have withdrawn

25aba1767.22 application, behaved with the deceased in such a way as he was left with no option but to commit suicide.

Considering the applicant No 1 being female and the applicant No. 3 being 58 years of age, the Court is inclined to grant protection to them. Hence, in the event of arrest of the applicants namely 1) Vijaya Nandu Kadam and 3) Nandu Vishnu Kadam, in connection with Crime No. 459 of 2022 registered with Shrirampur Police Station, Dist. Ahmednagar, for the offences punishable under Sections 306, read with Section 34 of the Indian Penal Code, 1860, they be released on their executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) each with one surety each in the like amount on following conditions :

(i) Applicant No. 1 and 3 shall not tamper with the prosecution evidence.

(ii) They shall appear before the investigating officer as and when required by him for investigation purpose.
