We have heard Mr. Thombre, the learned counsel for the petitioner, so also the learned A. G. P. and Mr. Nikam, the learned counsel for respondent No. 3.

The case of petitioners is to appoint the petitioners as assistant teachers. Mr. Nikam, the learned counsel appearing for the respondent No. 3 submits that, upon re-assessment 06 marks of the petitioner No. 1 are increased and 02 marks of the petitioner No. 2 are reduced. The petitioners eventually have secured 130 and 123 marks respectively. However, the cut off

2 wp 12394.15 marks for S.C. category are 133.

As the petitioners have secured less marks than the cut off marks in S.C. category, the case of petitioners could not have been considered. In view of that, the writ petition stands dismissed. No costs.
