By this application, the applicant is seeking restoration of the writ petition which was dismissed by an order dated 10.11.2023, on account of non removal of office objections. There is delay of 332 days in filing the present application for restoration of the writ petition and hence, the applicant has also prayed for condonation of the delay. 2.

We have perused the contents of the application and we find that although there is a statement made that Advocate for the applicant could not have knowledge about the order passed by the High Court, that in itself cannot be a ground to allow the application without imposing appropriate conditions, including costs.

In view of the above, the application is allowed. Delay is condoned and the writ petition is restored subject to removal of office objections within four weeks from today and further, on the condition that amount of Rs. 2500/- is deposited with the Creche/Day Care Centre, Advocates' Association of Bombay High Court, Bench at Aurangabad within the said period of time.
