IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 918 WRIT PETITION NO.133 OF 2023 GOVIND SHAMRAO GITE

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS AND WRIT PETITION NO.134 OF 2023 SOPAN NAMDEV MUSALE

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ....

Mr O. D. Totawad, Advocate h/f Mr S. A. Nagarsoge, Advocate for petitioners;

Mr V. M. Kagne, A.G.P. for respondent Nos.1 & 2 Mr P. D. Suryawanshi, Advocate for respondent Nos.3 & 4 CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.

DATE : 7th January, 2023 PER COURT:

1.

In both these matters, the identically placed petitioners claim to be bestowed with the honour of being 'Adarsha Gram Sevak' (Ideal Gram Sevak). Both are, therefore, entitled for advance increments, pursuant to the Government policy dated 10.11.1998. Our attention is drawn to page 16 of both the petitions, which is an order dated 31/12/2013, passed by the Zilla Parishad, Beed, declaring the petitioners as 'Adarsh Gram

133.23wp (2) Sevaks'. We are also pointed out the Government Resolution dated 24.08.2017, by which the scheme of granting advance increments for such 'Adarsha Gram Sevaks' has been discontinued. In several orders/judgments, delivered by this Court, this Government Resolution is held to be applicable prospectively. In view of the above, we are inclined to pass a similar order.

2.

Both the petitions are disposed off with a direction to respondent Nos. 3 and 4 to cause a verification exercise, up to 15/02/2023, in order to scrutinize the cases of these petitioners and confirm that they have been granted 'Adarsha Gram Sevak' Award. If they are found to be conferred with this honour, they shall be paid their outstanding monetary benefits, as expeditiously as possible and in any case, on or before 30.04.2023. 3.

In the event of any petitioners, pursuant to the verification/scrutiny, are found to be ineligible, a reasoned order be passed and the said order be communicated to the concerned petitioner, on or before 30.01.2023.
