The learned advocate for the petitioner states that, he is challenging the notice thereby asking the petitioner to remain present for the preliminary enquiry. According to the learned counsel, case under the Anti Corruption Act has been lodged against the petitioner. The said case is pending and is ripe for evidence. The Departmental Enquiry would jeopardize rights of the petitioner in the criminal case.

The notice, which is impugned in the present writ petition is notice for conducting preliminary enquiry and not departmental enquiry. We would have considered the case of the

In the light of the above, no interference is called for. The writ petition is disposed of. No costs.
