Mr.Bedre, learned counsel for Respondent submits that after conducting Departmental Inquiry, the petitioner is dismissed from service and the petitioner has filed appeal before the School Tribunal. The Subsistence allowance is also paid to the petitioner.

The petitioner disputes payment of subsistence amount after lapse of 120 days. The petitioner may approach the Education Officer. The Education Officer shall verify from the petitioner and the Respondent institution about the quantum of the subsistence allowance paid to the petitioner and after considering the say of both the parties shall take decision with regard to the entitlement of the petitioner for subsistence amount expeditiously.

The Writ Petition is disposed of. No costs.
