The applicant original plaintiff has moved this application for fixing final hearing date in the appeal on the grounds that appellant has already filed paper book, court has stayed decree in favour of the applicant-respondent original plaintiff, appellant is trying to create third party interest in the suit property. It is submitted on behalf of the applicant/original plaintiff that the defendant is in possession of the property. Learned counsel appearing for the respondent/ original defendant is not disputing the fact that he has filed the paper book.
