Present application has been filed by the State for getting the delay of 2217 days condoned in filing first appeal. The State intends to challenge the Judgment and award passed by the learned Reference Court.

The learned advocate appearing for the respondent - claimant is strongly objecting the application on the ground that, there is huge and inordinate delay which has not been properly explained at all. 3.
Taking into consideration the steps which were taken by the State to obtain various permissions and sanction and for the reasons stated in the application, liberal approach is taken. Delay is condoned. Application stands allowed and disposed of accordingly. 4.
It appears that, though a conditional stay was granted by this
CA 14968-2018 Court by order dated 14-12-2018, yet the amount has not been deposited. Learned AGP is making statement that, the demand is made to the State and efforts are being made to deposit the said amount within a period of eight weeks.

Hope with the efforts of learned AGP, the State would deposit the said amount within the aforesaid period.

Registry to verify and register the first appeal and place it for further consideration on 23-09-2019.
