These petitions, arise out of somewhat similar circumstances as appearing in Writ Petition No.555 of 2015 & companion matters (Gram Panchayat Naigaon Vs. State of Maharashtra), decided by this Court on 6th May, 2015.

For the reasons recorded by this Court while disposing of aforesaid group of writ petitions, instant matters also can be disposed of.

{2} wp1223115.odt Petitioners shall approach the Sub Committee at State Level, constituted in accordance with Clause 17 of the Government Resolution dated 26.05.2011, by tendering application(s)/ representation(s) within a period of two weeks from today. On receipt of application(s)/ representation(s)/grievances/complaints from petitioners by the Sub Committee at State level, the Committee shall take decision in observance of principles of natural justice, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of the application(s)/ representation(s)/grievances/complaints. Till decision is taken by the Sub Committee at State Level in respect of complaints those would be lodged by the petitioners, Respondents shall not issue an authorisation to the successful bidder(s) so as to facilitate them to excavate sand from the relevant sand spot(s).
