This petition is against an order passed by the scrutiny committee in the appeal filed by the petitioners challenging an order passed by the learned S.D.O. thereby refusing to grant caste certificates as they could not produce the sufficient evidence and mainly the document prior to 1950. Liberty is kept open by the appellate authority to approach the learned S.D.O. again. 2.

The learned advocate for the petitioners argues that, there is no difficulty in going back for the certificate, however, the learned S.D.O. is insisting for a proof or a document prior to 1950 in

This Court finds that, if otherwise, the authority is satisfied, there is no reason to insist for evidence prior to 1950 at this stage. Certainly, it is for the scrutiny committee to go into that question at the time of granting validity certificate. However, for the present, the certificate need not be refused only on that ground. 4.

Therefore, we allow this petition in terms of prayer clause (B). The petitioners to approach the concerned authority for issuance of caste certificates. The authority to issue such certificates without insisting any document prior to 1950. The decision be taken within two (02) weeks from today. 5.
