The proposal of the petitioner seeking validity of his tribe claim is not accepted and is returned back on the ground that tribe certificate is not in proper form.

We have heard learned Counsel for the petitioner and learned A.G.P.

The Tribe Certificate issued to the petitioner is in Form "C", which appears to be as per the rules. The petitioner shall re-submit the proposal with the respondent - Committee. In-case, there are certain

( 2 ) wp13667.17 deficiencies, the petitioner may comply the same and the Committee on receipt of proposal shall decide the proposal on its own merits, preferably within one year from the date of receipt of proposal.

If the proposal is submitted by the petitioner within two weeks from today to the Committee for validation, respondent No.2 shall not take adverse action against the petitioner only on the ground that the validation proceeding is pending.

In the light of above, the impugned notice is set aside.

The writ petition is disposed of. No costs.
