Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The allegations attributed to the applicant were that he hold the hands of the injured and the main accused assaulted him. It appears that he did not use the weapon nor assaulted the deceased and injured. There appears enmity between the deceased, injured and the accused. Nothing has been recovered from him. There are no antecedents to his discredit. The charge sheet has been filed. The trial may take its own time. Considering the role attributed to the applicant, he deserves bail. Hence, the following order :

(i) Bail Application is allowed.

(ii) Applicant SYED PASHA S/O. SYED HANIF be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.147 of 2022, registered by Police Station Kranti Chowk, District Aurangabad, for the offences punishable under 302, 307 read with Section 34 and Section 135 of the Maharashtra Police Act, on the condition not to tamper with the prosecution witnesses.
