VERSUS
THE STATE OF MAHARASHTRA THROUGH COLLECTOR LATUR AND AND ANOTHER ...
Advocate for Applicant : Mr. Gundre Suraj V.
CORAM : MANGESH S. PATIL, JJ.
DATE : 19/11/2019 PER COURT :
Not on board. Taken on board on mentioning.
2.
The learned advocate for the applicants in all these applications submits that for want of removal of office objections Registrar (Judicial) has passed a conditional order on 22.10.2019, to the effect that Registration of the First Appeals shall stand automatically refused if the objections were not removed till 19.11.2019 i.e. till today.
3.
The learned advocate submits that in fact there is a genuine dispute as to the office objection pertaining to the court-fees. He submits that he is ready to go before the Taxing officer and get the 1/2
Pr.1.odt issue decided. That being the only office objection, it would be appropriate that the issue regarding deficit court fees is referred to the Taxing Officer as per the Bombay High Court Appellate Side Rules. 4.
In view of above, the office shall refer the matters to the Taxing officer for determination of issue regarding Court fees. 5.
The applicants through their advocate shall appear before the Taxing Officer on 22.11.2019.
6.
The Civil Applications are disposed of.
