The petitioner, one of the participant in the e-tender process, sought quashing of the impugned decision dated 21st December, 2022, whereby EMD of the petitioner was returned and as consequence of which, the tender of the petitioner was rejected.

Pursuant to an interim order passed by this Court on 23rd December, 2022, respondent No.4 has placed on record documents, thereby stating that the tender process in question was completed after permitting the petitioner to participate in the same. According to Mr. Khandare, the price bid of the successful tenderers will be evaluated and appropriate decision be taken. 3.

Learned counsel for the petitioner has also submitted that it is informed by respondent no.4 that the bid submitted by the petitioner is highest.

In view of above, since the grievance made by the petitioner in the petition is already redressed as his bid is considered and the tender process is almost at the verge of completion, we permit the respondent No.4 to go ahead with the tender process. As the learned counsel for the petitioner submits that since his tender is already processed, the grievance stands redressed and the petition stands disposed of. (S. G. CHAPALGAONKAR, J.) (NITIN W.
