Mr. Swami, learned Counsel for the petitioner seeks leave to amend and challenge the action of the respondent Creditor in initiating Auction Proceeding. 2.

The Auction Proceeding is under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, referable to Section 13

(4) of the said Act. The petitioner has remedy before the Debt Recovery Tribunal under Section 17 of Securitisation and Reconstruction of Financial Assets and Enforcement of

In view of that, the Writ Petition is disposed of with liberty to the petitioner to avail an alternate remedy. All the contentions are kept open. No costs.
