It is submitted that at the time of scrutiny of the appeal filed by the present applicant, it was noticed that 53 days delay had occurred in filing the appeal. Since the appeal was not accompanied with the application for condonation of delay, it was not registered. It is further contended that this fact was noticed by the learned Counsel for the applicant belatedly but the moment it was noticed, the application for condonation of delay was filed. It is further contended that in making such compliance, delay of 500 days has occurred. For the reasons as aforesaid, the delay deserves to be condoned. It is accordingly condoned. The appeal be registered in accordance with law. Civil Application stands disposed of. ( P.R. BORA, J. ) AGP/-
