Upon perusal of the reasons assigned in the impugned order, it appears that the Chief Executive Officer, Zilla Parishad, Nanded has not adverted to / considered the Government Circular issued on 22nd January, by the General Administration Department and also the instructions issued by the Deputy Secretary, G.A.D., Government of

12312.15wp Maharashtra on 12th June, 1990 to all the departments. On this ground alone, we are inclined to quash and set aside the impugned order.

The impugned order dated 19th September, 2015 passed by respondent No.3 is quashed and set aside. The Chief Executive Officer, Zilla Parishad, Nanded is directed to reconsider the case of the petitioner in the light of the aforementioned circular and communication issued by the General Administration Department of the Government of Maharashtra. The Chief Executive Officer, Zilla Parishad, Nanded to reconsider the entire issue afresh, as expeditiously as possible; however, on or before 30th June, 2016 and take decision.

Writ Petition is allowed to above extent and stands disposed of. Parties to act upon authenticated copy of this order.
