The learned counsel for the appellant submits that, the application filed by the original claimants for withdrawal of the remaining amount came to be rejected by this court and therefore if this appeal is heard finally on merits on the next date, this application for withdrawal can be disposed of right now. The learned counsel for the applicant-original claimant has no objection if the appeal is fixed for hearing on the next date. 2.

In view of the above, the civil application is accordingly disposed of. Fix the matter for final hearing in the week commencing from 20.02.2017.
