Heard the learned counsel for the petitioner for some time. 2.

This Court expressed that unless the petitioner surrenders, this Court will not entertain the petition. However, since the petitioner has not surrendered, the learned counsel for the petitioner, on instructions, submits that the petitioner is ready to surrender. In view of the same, the petitioner to surrender. 3.

Learned A.P.P. vehemently opposed the petition. She submits that once the appeal is dismissed, there is no other way except to surrender and serve the sentence. The petitioner does not deserve any sympathy from this Court, looking at his conduct. However, considering peculiar facts of the case, the criminal writ petition is allowed to be withdrawn. If petitioner surrenders, his application be considered by the Court.
