The learned counsel appearing for petitioner craves leave to withdraw the petition with liberty to file appropriate application before the Principal District & Sessions Judge for clubbing of trials of Crime Nos. 237/2022, 407 of 2022 and 408 of 2022 registered against the appellant for the offence under sections 356 and 506 of Indian Penal Code and Sections 10 and 12 of the Protection of Children from Sexual Offences Act, 2012 as well as Section 3(1) (w)(i), 3(2)(5),3(ii)(v) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act with registered with Akhada Balapur Police Station, Hingoli and after filing of charge sheets which are registered as Sessions Case Nos. 48 of 2022, 94 of 2022 and 102

925wp2015-24 of 2022. Accordingly, the Criminal Writ Petition is disposed of as withdrawn with liberty as prayed.

Needless to say that if such application is filed, the learned Principal District & Sessions Judge shall decide the same on its own merits and the order dated 16.07.2024 passed below Exh. 27 in Special Case No. 48 of 2022 by the learned Additional Sessions Judge, Court No.3, Hingoli shall not be the legal impediment.

Fees of the Advocates appointed through the Legal Aid Panel shall be paid by the High Court Legal Services Sub Committee, Aurangabad as per schedule.
