This application is for restoration of Writ Petition No.8500 of 2013 which was dismissed for default by way of conditional order dated 25th June 2018. There is delay of 1601 days caused in filing the application. It is submitted by the learned Advocate that the petitioner happens to be a lady from schedule caste. She was allotted a fair price shop which she was running honestly. However, because of some complaints, the inquiry was started. Though she lost the battle before the Minister, she had good

Ethape ( 2 ) 21-CA-2259-2023 case on merits. The order dated 25th June 2018 was not communicated by the Advocate to her and it is for this reason, objection could not be removed and the matter stood dismissed.

Considering that, the petitioner happens to be a lady who was given fair price shop, this Court is inclined to allow the application by imposing costs.

In view of the same, petition stands restored to its original position subject to petitioner depositing costs of Rs.1,000/- to be paid to the office of Maharashtra Legal Aid Services Authority of this Court, within two weeks from today.

After restoration, place the petition on board dated 24th April 2025, in urgent admission category.
