This application is filed by the wife seeking transfer of Hindu Marriage Petition No. 24 of 2024 pending before the learned Civil Judge, Senior Division, Bhusawal to the Court of learned Judge, Family Court at Aurangabad.

It is the case of the applicant-wife that she is residing at Aurangabad with her old age parents. Her one sister and the mother suffering from mental illness and they are required treatment. There is

( 2 ) no one to accompany her to attend the Court at Bhusawal. A ready a proceeding under Domestic Violence Act is pending in the Court of learned JMFC, Aurangabad bearing PWDVA No. 201 of 2024. Learned Advocate for the applicant therefore prays for transfer the proceeding. 4.

Learned Advocate for the respondent opposed the application. 5.

However, looking to the settled position, this court finds that it would be in the interest of justice to allow the application. The application is therefore allowed. Hence, the following order:

ORDER

(i) Misc. Civil Application stands allowed in terms of prayer clause (B).

(ii) After transfer of the proceeding, the learned Judge shall try to dispose of the same as early as possible and preferably within one year from today.

(iii) The applicant-wife shall not seek any unnecessary adjournments. If such adjournments are sought, the Court may pass appropriate order compensating the husband.

( 3 ) (iv) If the husband makes a prayer to appear through video conferencing, such prayer be considered liberally by the Trial Court. (v) With this, Misc. Civil Application stands disposed of. [KISHORE C. SANT, J.]
