This application is filed by husband seeking transfer of the of the matrimonial proceeding pending in the Court of learned Judge, Family Court, Chh. Sambhajinagar to the Court of learned Civil Judge Senior Division, Pune.

The learned Advocate for the applicant strenuously submits that the respondent-wife is staying in USA. The proceeding is filed through GPA holder her sister, who stayed in Chh. Sambhajinagar. The applicant-

( 2 ) husband finds it difficulty to attend the Court proceeding by coming all the way from Pune to Chh. Sambhajinagar. This Court hardly finds any ground made out to transfer the proceeding. The other difficulty expressed is that one more proceeding is filed under the Domestic Violence Act bearing PWDVA No.537 of 2024 pending in the Court of learned JMFC, Chh. Sambhajinagar. The applicant is required to attend both the proceedings on different dates. This care can be taken by requesting the Court to grant same date in both the petitions. The Family Court can adjust the date as per date given in PWDVA proceeding. The applicant can also appear through video conferencing whenever possible. With this, the following order:

ORDER

(i) Application stands rejected.

(ii) The trial Court to grant the date as given in the PWDVA proceedings before the learned JMFC, Chh. Sambhajinagar. (iii) If the husband makes a request to appear through video conferencing, such request shall be considered liberally. (iv) The Trial Court shall try to dispose off the proceeding as early as

( 3 ) possible and preferably within one year from today. (v) With this, application stands disposed off.
