The present proceeding is filed for quashing of FIR bearing No. 177 of 2017 registered with the Deoni Police Station, Dist. Latur, for offence punishable u/s 379 r/w Section 34 of the Indian Penal Code.

During arguments, the learned Counsel for the petitioners has submitted that he has information that charge-sheet is filed but only against three persons and charge-sheet is not filed against the present petitioners who are four in numbers. SG Punde, PA

The learned APP submits that, he has a copy of chargesheet and it shows that, after completion of investigation, chargesheet came to be filed against three persons namely Sandipan More, Janardhan More and Sopan More. The present petitioners are not shown as accused in this matter in the charge-sheet. 4.

The submissions made show that the present petitioners were never arrested and they had obtained anticipatory bail. In view of these circumstances, this Court holds that the purpose of filing the present petition is apparently served. If there is any occasion arises in future in respect of the same crime, we grant liberty to the petitioners to approach this Court again. With this liberty, the petition stands disposed of.
