Applicant also seeks condonation of delay caused in preferring application for setting aside abatement and for bringing legal heirs of the deceased Sandipan Shahajirao Mane on record.

The respondent - acquiring body did not take any steps to bring legal heirs on record. The cause of action survives as against the legal heirs. They are necessary parties. The delay is not intentional.

The civil application is allowed in terms of prayer clauses

Amendment shall be carried within a period of two (02) weeks from today.
