This is an Application for suspension of substantive sentence. 2.

Heard both the sides.

The Applicant is convicted for the offence punishable under Sections 498-A and 323 of the Indian Penal Code, 1860 [hereinafter referred to as 'IPC'] and sentenced to suffer Rigorous Imprisonment for one [01] year and fine of Rs.5000/-, in default to suffer Rigorous Imprisonment for one [01] month; and to suffer Simple Imprisonment for one [01] month and fine of Rs.500/-, in default, to suffer Simple Imprisonment for eight [08] days, respectively.

The sentence has been suspended by the learned Trial Court till the Appeal period is over. Considering the short-term sentence, the same is suspended. Hence, the following order :

ORDER

[I] Criminal Application is allowed.

[II] The substantive sentence imposed upon the Applicant, namely, Pankaj Nivrutti Sonawane, by the learned Additional Sessions Judge, Sangamner, District Ahilyanagar, vide Judgment and Order dated 29/10/2025, passed in Sessions Case No.31/2020, is hereby suspended till the final disposal of the Appeal.

[III] The Applicant be released on bail on furnishing S.B and P.B. of Rs.15,000/- [Rupees Fifteen Thousand] with one surety in the like amount before the learned Trial Court.

[IV] The Applicant shall co-operate in early disposal of the Appeal. [V] Criminal Application stands disposed off accordingly. [NEERAJ P. DHOTE, J.] Sameer/November-2025
