Learned A.G.P. for the respondent Nos. 1 and 2 in the light of para No.9 of affidavit in reply submits that on 1.1.2016, which was the last date for withdrawal of nomination forms, only 13 nomination forms were remained out of 27 valid nomination forms. Thus, as against 13 seats, 13 nomination forms remained in the fray i.e. one against each seat. Learned A.G.P. further submits that in view of this, the Returning Officer on 1.1.2016 itself has declared all 13 candidates as elected against 13 seats in the said elections. 2.
In the light of above circumstance, learned counsel for the petitioner, on instructions, seeks leave to withdrawn this writ petition with liberty to raise all the grounds in election petition, as are raised in this writ petition. Leave granted with liberty as prayed for. Writ petition is disposed of as withdrawn.
