IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 942 CIVIL APPLICATION NO.1697 OF 2020 IN FAST/37037/2018 RAMKISAN MARUTI WAMAN AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER ...

Advocate for Applicants : Mr.

Tungar Nikhilesh K.

AGP for Respondents - State : Mr. P. M. Kulkarni ...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 15.11.2022 PER COURT :

Heard rival submissions. The respondent No. 2 - Acquiring Body though served, but remained absent. The applicants are seeking condonation of delay of 1446 days which appears to be caused due to their financial crisis. The learned AGP strongly opposed the application on the ground that there is circulation delay. 2.

However, considering the statutory right of the applicants, the delay of 1446 days stands condoned subject to condition that the applicant shall not claim any interest for the aforesaid period of delay and also for the delay in circulating the matter belatedly.

3.

The appeal be placed for admission after removal of office objections, if any.

4.

The application is accordingly disposed of.
