This application is filed by the wife seeking transfer of proceeding of H.M.P. No. 232/2024 pending in the Court of learned C.J.S.D., Sillod to the Court of learned Judge, Family Court at Aurangabad.

It is stated in the application that, the applicant stays with her parents. There is no one to accompany her to go to the Court at Sillod. She is also having a daughter of 12 years. She find it difficult to travel with her. Therefore, the learned advocate for the

The learned advocate for respondent vehemently opposes the application. He submits that, the distance between two places is hardly 60-65 kms. Transport facilities are available. The Court at Sillod has the jurisdiction to try the H.M.P. No. 232/2024. 5.

Considering that the applicant is a lady staying with her parents and a daughter of 12 years age this Court finds it in the interest of justice to allow the application. Hence, following order :

ORDER

(I) Misc. Civil Application stands allowed in terms of prayer clause (B).

(II) After transfer of the proceeding, the applicant - wife shall not seek any unnecessary adjournments. If the Court finds that, the adjournments are sought unnecessarily, the Court may impose cost so as to compensate the respondent - husband if he remains personally present.

(III) The learned Trial Court is requested to try to endeavour to
