The civil application is filed for withdrawal of amount. Learned Advocate Mr. Arora appearing for the acquiring body in the first appeals vehemently opposes the application. 2.

In view of earlier orders passed on 30.03.2023 in Civil Application No. 1781 of 2023 in First Appeal No. 2010 of 2022 as well as 25.11.2024 in civil application No. 7592 of 2024 in first appeal No. 1994 of 2022 and since only 80% amount is deposited in this Court, the applicant is permitted to withdraw entire amount deposited in this

ca672.25 -2Court on following conditions.

(i) The applicant is permitted to withdraw 50% of the entire amount of award along with accrued interest on furnishing usual undertaking.

(ii) Further 30% of the entire amount of award along with accrued interest is permitted to be withdrawn on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court.

(iii) The civil application is accordingly allowed and disposed of.
