Learned Senior Advocate for the respondents submits that under sub section 6 of section 79 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 the order of termination can be challenged by filing appeal before the Director of Municipal Administration.

Learned advocate for the petitioner submits that the petition is pending since 2016 and therefore this objection may not be entertained.

In view of alternate efficacious remedy available to the petitioner, writ petition is disposed of by granting liberty to the petitioner to approach the Director of Municipal Administration by filing appeal. The petitioner shall file appeal within four weeks from today. The period spent by the petitioner in prosecuting the present writ petition shall be taken into consideration while condoning the delay.
