The Applicant prays for staying the judgment of the learned Appellate Court dated 20.10.2004. Second Appeal No.930/2005 is ready for final hearing.

The hearing of this Civil Application itself would amount to considering all contentions of the litigating sides in the Second Appeal, which is pending for 12 years. Therefore, propriety demands that the Second Appeal itself be heard finally.

In the light of the above, this Civil Application is disposed of. By consent of the parties, list Second Appeal No.930/2005 for final hearing on 18.01.2018. All grievances of the Applicant will be considered in the Second Appeal.
