IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 1015 WRIT PETITION NO.13588 OF 2018 MANDAR SURESH BAHEGAVANKAR

VERSUS

THE STATE OF MAHARASHTRA AD OTHERS ...

Advocate for Petitioners : Mr. Shrikant Kulkarni AGP for Respondent No.1: Ms. R.P. Gaur.

Adv. for respondent No.2 Mr. A.R. Borulkar.

. . .

CORAM : S.S. SHINDE & K.K. SONAWANE, JJ.

DATE : 7th DECEMBER, 2018.

PER COURT:

1] By this petition, the petitioner is seeking direction to the respondent Nos. 2 and 3 to permit the petitioner to attend the Winter Semester Examination of the First Year Engineering Course. 2] Admittedly, the petitioner's attendance was below 50%. The learned counsel for the petitioner invites our attention to the reasons stated in the petition and submits that for reasons which were beyond the control of the petitioner, the petitioner could not attend the classes and, therefore, the respondent Nos. 2 and 3 may be directed to permit the petitioner to attend the Winter Semester Examination of the First Year Engineering Course.

3] In our opinion, the academic standards are set by the University for the colleges, which are under the control of the University. It is not for

{2} 1015 sr. no..odt the High Court to interfere in the academic standards set down by the University. In that view of the matter, we are unable to grant any relief to the petitioner. However, it will be open for the petitioner to persuade the respondent Nos. 2 and 3 for said permission.

4] For the aforesaid reasons, writ petition stands disposed of. [K.K.SONAWANE] [S.S. SHINDE] JUDGE JUDGE grt/-
