Applicant seek to condone the delay of 1264 days caused in filing application for setting aside abatement and bringing the legal heirs of deceased Phulabai Devkar on record. 2.

The cause of action survives against the legal heirs of the deceased Phulabai. They are necessary parties. It is desirable to condone the delay.

The civil application is allowed in terms of prayer clauses 'A' and 'B' The civil application is disposed of.
