IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO. 13507 OF 2024 IN WP/6059/2020 SHREYA UDHAV MULE AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA THROUGH PRINCIPAL SECRETARY AND OTHERS ...

Advocate for Applicants : Mr. Temak Rahul B.

AGP for Respondents: Mr. A.S. Shinde ...

CORAM : S. G. MEHARE AND SHAILESH P. BRAHME, JJ.

DATE : 13th DECEMBER 2024 PER COURT :

.

Heard learned Counsel for the applicants and learned AGP. None appears for respondent nos. 4 to 5, though they are served. 2.

The applicants are seeking direction for releasing the documents withheld by the respondent no.5/College. The applicants completed BDS course. They are in need of documents for further education.

3.

Our attention is invited to the common order dated 11.12.2023 passed in Writ Petition No.12262/2019 and the connected matters. The petitioners were also before the Court and claiming entitlement to EBC and free-ship fees for the B.D.S. course. The coordinate bench directed the College that time also to release the documents on furnishing undertaking.

2 909.CA-13507-2024.doc 4.

Learned AGP opposes the request of the petitioners on the basis of Government policy. He submits that the applicants are liable to pay entire fees to the College and they cannot claim exemption policy of EBC and free-ship fees.

5.

As there is already order of the coordinate bench referred above on identical facts, we adopt the same course. 6.

We direct the respondent no.5/College to return all the original documents to the applicants on submitting specific undertaking before this Court individually, within two weeks from today.

7.

Civil Application is disposed of.
