Heard learned counsel for the petitioner. He submits that on 08.02.2024, by mistake a statement has been made that the proceeding is pending before the Debts Recovery Tribunal. After passing the order, he submits that the said statement has been made inadvertently. As per the report from the Office of the Debts Recovery Tribunal, no any proceeding is pending before the Debts Recovery Tribunal. Hence, the observations in the said order in paragraph nos.4 and 5 may kindly be expunged. He further submits that against the impugned order, a statutory remedy is available. Hence, leave may be granted to withdraw the petition.

Perused the report of the Debts Recovery Tribunal. It seems that on 08.02.2022, he has made incorrect statement

02-wp-14212-2023.odt (2) inadvertently. Therefore, the observations made in the order dated 08.02.2024 in paragraph nos.4 and 5 have been expunged. Those paragraphs be deleted from the order and fresh order be uploaded. 3.

Leave granted to withdraw the petition, as statutory remedy is available.
